CHARGE(S): Possession of Heroin, in violation of Ohio Revised Code 2925.11, a fifth degree felony

POTENTIAL PENALTY: One year in the Ohio Department of Corrections

VENUE: Hamilton County Court of Common Pleas, Cincinnati, Ohio

DISPOSITION: At Motion to Suppress Hearing Mr. Bennett argued that police had no reasonable suspicion or probable cause to stop the vehicle Defendant was operating. Therefore, heroin found in pants pocket of Defendant after he was stopped should be excluded as evidence from the trial of the case.

RESULT: Case dismissed after supplemental motion to suppress filed.
