DOMESTIC VIOLENCE

Mr. Bennett has extensive experience and a significant history of successfully and aggressively defending individuals charged with committing domestic violence. His experience dictates that often times people make false allegations of domestic violence for personal relationship reasons and/or to gain leverage in divorce or custody cases. Moreover, because of the prevalence of domestic violence, the public opposition to it and the preferred arrest policy in domestic violence cases (police are required to take action if there is any evidence that domestic violence occurred) the police often improperly charge individuals with domestic violence. Furthermore, Ohio prosecutors do not dismiss domestic violence cases even if the alleged victim does not want to prosecute the defendant or admits his or her allegations are false. In light of the forgoing, Mr. Bennett is inherently suspicious of domestic violence charges. As a result of his zealous representation, he has obtained hundreds of acquitals and dismissals for his clients accused of domestic violence.

Domestic violence is the physical or verbal abuse of a household member, intimate partner or family member. It is a crime with serious consequences even though it may result from minor physical injuries and/or the threat of violence. Individuals convicted of domestic violence will suffer permanent, severe consequences including a non-expugnable criminal record and permanent prohibition from possessing a firearm. A domestic violence charge and/or conviction may also result in court orders prohibiting the defendant from entering their home and/or contacting their family. As with other crimes, a domestic violence conviction can result in payment of restitution, fines, probation and/or the serving of jail time.

Any person charged with committing domestic violence should contact an attorney as soon as possible. The attorney should be experienced in successfully handling domestic violence cases.
