CHARGE(S): Murder with three year gun specification, in violation of Ohio Revised Code 2903.02(E), murder with a three year gun specification, in violation of Ohio Revised Code 2903.02(B), felonious assault with a three year gun specification, in violation of Ohio Revised Code 2903.11(A)(1), felonious assault with a three year gun specification in violation of Ohio Revised Code 2903.11(A)(2), felonious assault with a three year specification in violation of Ohio Revised Code 2903.11(A)(1) and felonious assault with a three year gun specification in violation of Ohio Revised Code 2903.11(A)(2).

POTENTIAL PUNISHMENT: Mandatory minimum: 26 years to life in prison; maximum sentence: 34 year to life in prison.

VENUE: Hamilton County Court of Common Pleas, Cincinnati, Ohio

ALLEGATIONS: This high profile case against Mr. Mosley was covered day to day by local news media and received state, regional and national interest. A male black gang member shot and killed a seventeen year old white female innocent bystander and critically injured two other teenagers attending a "sweet sixteen birthday party." This was done while he was attempting to shoot to death a rival gang member. The race of the Defendant and the decedent is emphasized to demonstrate Mr. Bennett's ability to neutralize the issue of race in a racially charged case. The State of Ohio argued that Mr. Mosley was the primary assailant or acted in concert with other gang members who were shooting guns outside the party. Therefore, Mr. Mosley was guilty of murder and felonious assault if the jury believed he fired a gun.
