State of Ohio V. Henderson

POTENTIAL PUNISHMENT: Life in Prison.

VENUE: Hamilton County Court of Common Pleas, Cincinnati, Ohio

ALLEGATIONS: Defendant struck, shook, threw and slammed his four month old son against an object causing the infant to sustain a skull fracture, subdural hematoma, multiple retinal hemorrhages and multiple rib fractures. After a plea to felonious assault and child endangering for injuring his infant son, the defendant was indicted for murder after the infant son died years later from his injuries.

DISPOSITION: Mr. Bennett filed a Motion to dismiss the new murder indictment on the grounds that Mr. Henderson's earlier plea to felonious assault and child endangering was a "negotiated guilty plea" and therefore, further prosecution of Mr. Henderson for the same conduct was barred.

RESULT: Murder charge dismissed
