CHARGE: Rape
POTENTIAL PUNISHMENT: 10 years in prison as an adult. Prosecutors zealously sought to try juvenile as adult and classify him as sexual offender.
VENUE: Butler County, Hamilton, Ohio
ALLEGATION: 15-year-old Lakota West High School student assaulted a classmate on the bus then pulled down the classmate's pants and pinned the boy down while a second teen repeatedly penetrated the boy's rectum with a pencil.
DISPOSITION: During bindover hearing in juvenile court, (procedure to determine if juvenile will be tried as an adult), Mr. Bennett successfully argued that his juvenile client should not be tried as an adult.
RESULT: Mr. Bennett's juvenile client received counseling in a juvenile rehabilitation program. He received no jail time and no classification as a sexual offender.
